VENUE: Rooftop Parking Lot, Winifred Mandela Precinct, Bryanston, Sandton
Parties. This agreement is between VO2Max Private Gym CC (registration number 2005/161192/23), trading as The Lisa Raleigh Group, together with bounceCHELLA, bounti, the venue, participating studios, sponsors, vendors, instructors, staff, volunteers, contractors, the event's appointed medical service provider, and their respective owners, members, employees, agents and representatives (collectively, the "Organisers"), and the undersigned participant or parent/legal guardian ("Participant" or "Guardian", as applicable).
Purpose. In exchange for being permitted to attend or participate in bounceCHELLA (the "Event"), the undersigned agrees to the terms below. This form applies to the main rebounding event, the Kiddies' Zone and all related activities at the venue.
Important risk warning
REBOUNDING AND EVENT PARTICIPATION ARE PHYSICALLY DEMANDING AND MAY RESULT IN INJURY, ILLNESS, DISABILITY, DEATH OR PROPERTY LOSS, EVEN WHEN REASONABLE PRECAUTIONS ARE TAKEN.
Risks include falls; collisions; equipment failure; strains, sprains and fractures; head, neck or spinal injury; dizziness, dehydration, heat illness, cardiac or respiratory events; aggravation of known or unknown conditions; crowd-related incidents; slipping or tripping; exposure to sun, wind, rain or other weather; and risks arising from other participants or from personal or third-party equipment.
Participant declarations
• I participate voluntarily and understand the nature and demands of the Event.
• I am physically and medically fit enough to participate, or I have obtained appropriate medical advice. I have disclosed below any condition, injury, pregnancy, medication, allergy or support need that may affect safe participation.
• I will immediately stop and seek assistance if I feel pain, faintness, unusual shortness of breath, chest discomfort, nausea, confusion or any other concerning symptom.
• I will follow all safety instructions, remain within my ability and experience level, maintain adequate spacing, and not attempt skills or intensity that I cannot safely control.
• I will not participate while impaired by alcohol, recreational drugs, illness, fatigue or medication that may affect balance, judgment or coordination.
• I will wear permitted non-slip socks or bounti Soles. I understand that barefoot bouncing and takkies/trainers are not permitted.
• I will bring water in a non-glass container, stay hydrated, use suitable sun protection and wear appropriate exercise clothing.
Pre-participation health screening
Answer the following honestly. A "yes" answer does not automatically prevent participation, but you must obtain medical clearance before taking part if you answer yes to any question, and you must tell event staff before you begin.
• Has a doctor ever told you that you have a heart condition, or should only do physical activity recommended by a doctor?
• Do you feel pain or discomfort in your chest during physical activity, or have you experienced this in the past month?
• Have you lost your balance because of dizziness, or lost consciousness, in the past 12 months?
• Do you have a bone, joint or soft-tissue problem (for example, back, knee, hip or shoulder) that could be aggravated by jumping or rebounding exercise?
• Are you currently pregnant, or have you given birth in the last 6 weeks?
• Are you taking medication for a heart condition, blood pressure, or any condition that could affect balance, coordination or consciousness?
• Do you have epilepsy, a seizure disorder, or any other condition that could make jumping exercise unsafe without supervision or precautions?
• Do you know of any other reason you should not do physical activity without medical supervision?
If you answered "yes" to any question above and have not yet obtained medical clearance, please speak to event staff before participating.
Terms and conditions
1. Assumption of risk and personal responsibility
The Participant knowingly accepts the ordinary and inherent risks of the Event, including those described in the risk warning, to the fullest extent permitted by South African law. The Participant remains responsible for choosing an appropriate level of effort, monitoring their own condition and complying with instructions. Advice or instruction provided at the Event is general fitness guidance and is not medical advice or an individual guarantee of safety.
2. Participant-supplied rebounders and personal equipment
A Participant who purchases a "bring your own rebounder" ticket is solely responsible for selecting, transporting, assembling, positioning, securing, using, supervising and removing that rebounder and any personal accessories.
• The Participant warrants that their rebounder is of sound and suitable quality; is designed for rebounding exercise; is stable, correctly assembled and well maintained; and has no worn, loose, missing, damaged, modified or defective parts.
• The Participant must inspect the rebounder before use and throughout the Event. If there is any doubt about its condition, stability or suitability, it must not be used.
• The Organisers do not inspect, certify, approve or guarantee participant-supplied rebounders merely by allowing them onto the premises or allocating a space.
• The Organisers may refuse or stop use of any rebounder considered unsafe, unsuitable, disruptive or incorrectly positioned. This does not transfer responsibility for the rebounder to the Organisers.
• To the fullest extent permitted by law, the Organisers are not liable for injury, death, loss, damage or expense caused by or connected with the poor quality, defect, failure, incorrect assembly, inadequate maintenance, misuse or unsuitability of a participant-supplied rebounder or accessory.
• Any loss of or damage to a participant-supplied rebounder during transport, set-up, use, storage or removal remains the Participant's responsibility. The Organisers are not required to repair, replace or reimburse it, except to the extent liability cannot lawfully be excluded.
3. Organiser-supplied equipment
Participants allocated an organiser-supplied rebounder or other equipment must use it only as directed, must not alter or move it without permission, and must immediately report any apparent defect or instability. Equipment is shared event equipment and no particular make, model or position is guaranteed. Deliberate, reckless or negligent damage may be charged to the responsible Participant to the extent permitted by law. The Organisers maintain and inspect organiser-supplied rebounders in line with the manufacturer's specifications and applicable safety standards; this does not remove the Participant's own obligation under clause 1 to report a suspected defect immediately and stop use if in doubt.
4. Property, theft and security
All rebounders, bags, phones, vehicles and other belongings are brought to and left at the venue at the owner's risk. Participants must clearly mark their rebounders and keep valuables secure. The Organisers do not provide secure storage and, to the fullest extent permitted by law, accept no responsibility for theft, loss, misplacement or damage, whether at the rooftop event area, parking areas or elsewhere at the precinct. Any suspected theft should be reported promptly to event staff and venue security.
5. Weather and outdoor conditions
The Event is planned for an outdoor rooftop venue. Weather and surface conditions can change quickly. If rain, lightning, excessive wind, heat or another unsafe condition arises, the Organisers will make reasonable efforts to implement a practical contingency plan. This may include delaying, pausing, shortening, modifying, relocating, rescheduling or cancelling all or part of the Event. Participants must follow announcements and safety directions and must not continue bouncing when instructed to stop. The Organisers do not guarantee uninterrupted participation or a weather-free event. Any refund, credit or rescheduling remedy will be handled in accordance with the ticket terms and applicable law.
6. Event format, crowd and conduct
The schedule, instructors, workout sequences, studio zones, vendors, prizes and activities may change for operational or safety reasons. The Participant will check in, wear the allocated wristband, use only the assigned space or rebounder, maintain safe clearance, and act respectfully. The Participant must not throw objects, bring glass into the activity area, obstruct walkways or behave in a way that endangers or harasses another person. The Organisers may remove or refuse participation to anyone who breaches these requirements, appears unfit to participate, or creates a safety risk.
7. Accessories and third-party products
The main workout is equipment-free. If the Participant elects to use personal weighted gloves, ankle weights, leg sleeves or another permitted accessory, they do so voluntarily and at their own risk, after ensuring that the item is suitable, secure and used within their capability. Products, food, drinks, samples, services or advice supplied by sponsors or vendors are provided by the relevant third party. Participants are responsible for checking ingredients, allergens, instructions and suitability.
8. Emergency care and medical costs
The Participant authorises the Organisers to provide reasonable first-response assistance and, where reasonably considered necessary, to contact the listed emergency contact and arrange ambulance, hospital or other emergency assistance. This authority does not create a duty to provide medical personnel or guarantee any particular response time or outcome. The Participant remains responsible for medical, transport and related costs, except where the law provides otherwise. The Participant must provide accurate emergency and health information and carry any personally required medication, such as an inhaler or adrenaline auto-injector. Participants are strongly encouraged to have their own medical aid, hospital plan or travel/personal accident insurance in place before the Event, as the Organisers do not carry medical expense cover for Participants and are not responsible for ambulance, hospital or treatment costs.
9. On-site medical service provider
The Organisers will arrange for a paramedic or other qualified medical service provider to be present at the Event. That provider is an independent contractor engaged to render emergency first-response care and is not an employee, partner or agent of the Organisers. The presence of a paramedic is a first-response measure only; it is not equivalent to hospital-level care, does not guarantee a particular standard of care, response time, capacity or outcome, and does not extend to conditions or complications requiring a higher level of care than can reasonably be provided on-site. To the fullest extent permitted by law, the Organisers are not liable for the acts or omissions of the independent medical service provider, save to the extent the Organisers' own gross negligence or wilful misconduct in selecting or engaging that provider caused the harm. The provision of first aid or emergency assistance to a Participant is not, and must not be treated as, an admission of liability by the Organisers or by the medical service provider.
10. Release and limitation of liability
To the fullest extent permitted by law, the Participant releases and waives claims against the Organisers for injury, illness, death, property loss or damage arising from the inherent risks of the Event; the Participant's own acts or omissions; another participant's acts or omissions; participant-supplied equipment; weather; or ordinary negligence. Nothing in this agreement excludes or limits liability for gross negligence, wilful misconduct, or any right or liability that may not lawfully be excluded or limited under the Consumer Protection Act 68 of 2008 or other applicable law.
11. Indemnity
To the fullest extent permitted by law, the Participant indemnifies and holds the Organisers harmless against third-party claims, losses, damages, costs and reasonable legal expenses arising from the Participant's breach of this agreement; negligent, reckless or intentional conduct; misuse of equipment; unsafe participant-supplied rebounder or accessory; damage to property; or injury or loss caused to another person. This indemnity does not apply to the extent a claim results from an Organiser's gross negligence or wilful misconduct, or where the law prohibits the indemnity.
12. Photography, filming and event media
The Participant understands that photography, video and audio recording will take place at a large public-facing event and that incidental appearance in crowd or background footage may be unavoidable. Where consent is selected below, the Participant grants the Organisers a worldwide, royalty-free right to record, edit, reproduce and use their likeness and voice for event, archival, promotional, advertising and social-media purposes, without further approval or compensation. The Organisers will not intentionally use a clearly identifiable person who has declined consent as a featured subject, but cannot guarantee exclusion from wide-angle or incidental crowd footage.
13. Personal information
The Organisers process personal information supplied on this form in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA), for event administration, safety, emergency response, legal and record-keeping purposes. Health information and identity/passport numbers are treated as confidential and shared only with personnel or emergency responders who reasonably need it. Records will be retained for no longer than 12 months after the Event, or such longer period as is reasonably necessary for legal, insurance or safety record-keeping purposes or required by law, after which they will be securely deleted or destroyed. Participants may contact the Organisers to request access to, correction of, or deletion of their personal information, subject to the Organisers' lawful record-keeping obligations.
14. General
This agreement is governed by the law of South Africa, and the Participant submits to the non-exclusive jurisdiction of the South African courts in respect of any dispute arising from it. If any term is invalid or unenforceable, it will be limited or severed to the minimum extent necessary and the remaining terms will continue. This document, together with the applicable ticket and event terms, records the agreement concerning participation. No failure to enforce a term is a waiver. Headings are for convenience only.
Additional terms for children and the Kiddies' Zone
This section applies where a parent or legal guardian signs for a child under 18, including a child aged 3-9 attending the Kiddies' Zone and a child aged 10-17 participating in the main event.
• I confirm that I am the child's parent or legal guardian and have authority to sign this form and make emergency decisions for the child.
• I have accurately disclosed the child's age, allergies, medical conditions, medication, behavioural or support needs, and any person authorised to collect the child.
• I understand that the Kiddies' Zone is a supervised event activity area, not medical care or specialist childcare. I will remain at the Event, remain reachable on the number supplied and collect the child promptly when requested or when the Event ends.
• I will ensure that the child follows staff instructions, stays within the designated area and does not enter the rebounder activity area unless holding the correct ticket and expressly permitted to participate.
• I accept the ordinary risks of age-appropriate games, movement, crowds, outdoor conditions and interaction with other children. I authorise reasonable first-response and emergency assistance on the same basis as clause 8.
• If the child is aged 10-17 and participates in the main rebounding event, I confirm that the child is physically capable of doing so and will be appropriately supervised.
